Please read these terms carefully before using FreshBoard. By accessing or using our service, you agree to be bound by these terms and conditions.

1. Agreement to Terms

By downloading, installing, accessing, or using the FreshBoard mobile application (the “App”), you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and FreshBoard. If you do not agree to these Terms, you must not use the App. We recommend reviewing these Terms periodically, as your continued use of the App signifies your acceptance of any updates or modifications.

2. Description of Service

FreshBoard is an AI-powered kitchen management application designed to help you reduce food waste and streamline your kitchen operations. The service includes:

Inventory Tracking

Monitor your food inventory with barcode scanning and camera-based product analysis.

Recipe Suggestions

AI-generated recipes based on your available ingredients and dietary preferences.

Meal Planning

Weekly and daily meal planning with smart ingredient optimization.

Waste Analytics

Track and analyze your food waste patterns to reduce spoilage.

Price Comparison

Compare grocery prices across nearby stores to find the best deals.

Shopping Lists

Smart shopping lists that sync with your meal plans and inventory.

3. Account Registration

To use FreshBoard, you must create an account. By registering, you agree to the following:

  • Age Requirement: You must be at least 13 years of age to create an account and use FreshBoard.
  • Accurate Information: You must provide accurate, current, and complete information during the registration process and keep it updated.
  • Account Security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • One Account Per Person: Each individual may only maintain one FreshBoard account. Creating multiple accounts may result in suspension or termination.
  • Notification: You must notify us immediately if you suspect any unauthorized use of your account.

4. Subscription & Payments

FreshBoard offers two service tiers:

Free Tier

Core features including inventory tracking, barcode scanning, basic notifications, and shopping lists. Advertisements are displayed to help support the service.

Premium Tier

All free features plus AI-powered recipe suggestions, meal planning, nutrition intelligence, price comparison, waste analytics, and a completely ad-free experience.

  • Premium subscriptions are billed through Google Play. Pricing is displayed in your local currency within the App.
  • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription at any time through your Google Play Store settings.
  • Refunds are handled in accordance with Google Play's refund policy.

5. User Content

You retain full ownership of all data you create and store within FreshBoard, including but not limited to:

  • Product inventory data (names, brands, quantities, expiry dates)
  • Custom and saved recipes
  • Meal plans and shopping lists
  • Dietary preferences and household settings
  • Waste tracking logs

By using the App, you grant FreshBoard a limited, non-exclusive, revocable license to process, store, and transmit your content solely for the purpose of providing and improving the service. We will not use your content for any other purpose without your explicit consent.

6. AI Features & Accuracy

FreshBoard uses artificial intelligence to provide various features. Please understand the following limitations:

  • Informational Only: All AI-generated suggestions, including recipes, meal plans, and product analysis, are provided for informational purposes only and do not constitute medical, nutritional, or financial advice.
  • Allergy Verification: Recipe suggestions are generated based on your available ingredients and preferences. You are solely responsible for verifying that recipes are safe for your specific dietary needs and allergies.
  • Nutrition Data: Nutritional information is sourced from the USDA FoodData Central database and may not be exact for every product variant. Use it as a general guide, not as a definitive source.
  • Price Estimates: Price comparisons are estimates based on data from the Open Price Engine and may not reflect real-time pricing at all stores.

Always consult healthcare professionals for dietary concerns, especially regarding food allergies, intolerances, or medical conditions. FreshBoard should not be used as a substitute for professional advice.

7. Acceptable Use

By using FreshBoard, you agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable local, state, national, or international laws.
  • Attempt to access, tamper with, or use non-public areas of the App, our systems, or other users' accounts or data.
  • Abuse the AI features by submitting malicious, harmful, misleading, or inappropriate content for processing.
  • Circumvent, disable, or interfere with rate limiting, abuse detection, security features, or other protective measures.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
  • Use automated scripts, bots, or scrapers to interact with the App without our prior written consent.

8. Intellectual Property

The FreshBoard name, logo, visual design, user interface, features, and all associated content are the exclusive property of FreshBoard and are protected by applicable intellectual property laws, including copyright, trademark, and trade dress.

Certain components of the App may utilize open-source software, which is credited and governed by their respective licenses. Nothing in these Terms grants you any right, title, or interest in our intellectual property beyond the limited right to use the App as described herein.

9. Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Limitation of Liability

To the maximum extent permitted by applicable law, FreshBoard is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. Specifically:

  • We are not liable for any food safety decisions you make based on information provided by the App, including expiry date tracking and storage recommendations.
  • We are not liable for allergic reactions or adverse health effects resulting from recipes or nutritional information provided by the App.
  • We are not liable for financial decisions made based on price comparison data or shopping recommendations.
  • We are not liable for damages arising from service interruptions, data loss, or third-party service outages.

Our total aggregate liability shall not exceed the amount you paid for the App in the 12 months preceding any claim.

11. Termination

  • By Us: We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in abusive behavior, or if we reasonably believe your account has been compromised. We will make reasonable efforts to notify you before termination unless the violation is severe.
  • By You: You may delete your account at any time through the App (Settings → Delete Account) or via our account deletion page. Upon deletion, all your data will be permanently removed within 30 days.

Termination of your account does not relieve you of any obligations incurred prior to termination, including any outstanding payment obligations.

12. Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. In the event of any dispute arising out of or relating to these Terms or your use of the App:

  • Informal Resolution: We encourage you to contact us first at thawndev@gmail.com to attempt an informal resolution.
  • Mediation: If informal resolution fails, both parties agree to attempt mediation before pursuing any other form of dispute resolution.
  • Binding Arbitration: If mediation is unsuccessful, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through in-app notifications or via email at the address associated with your account. The updated Terms will include a revised “Effective Date” at the top of the document. Your continued use of the App after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree with the changes, you must stop using the App and may delete your account.
